ACCC takes chicken industry to court

Have you seen recent Steggles ads trying to convince you that their chickens are 'free to roam' in large barns — enjoying the good life? If these claims made you suspicious, you're not alone.

In reality, factory farmed chickens are confined at such high densities inside sheds that they cannot roam around freely. Following a complaint lodged by the Barristers Animal Welfare Panel (assisted by Animals Australia and Lawyers for Animals), the Australian Competition and Consumer Commission (ACCC) found reason to take Steggles producers Baiada and Bartter, La Ionica producer Turi Foods, and the Australian Chicken Meat Federation to the Federal Court — alleging misleading or deceptive advertising related to claims about the treatment of chickens raised for meat.

Update: 10th January, 2012 -- Chicken meat company La Ionica has agreed to settle, being ordered to pay a $100,000 fine, remove the misleading advertisement from shops and publish an ad admitting liability in a Melbourne newspaper. The remaining defendants (two chicken meat companies and the Australian Chicken Meat Federation) are continuing with the case, which will go to court in March of this year.

The defendants have over the past several years used the claim that chickens raised for chicken meat are 'free roaming' or 'free to roam in large barns' in their advertising, on product packaging and/or websites — giving consumers the false impression that factory farmed chickens are afforded substantial space allowing them to roam freely. But the ACCC alleges that the population density of meat chickens raised in barns preclude such movement.

For the vast majority of their lives, these birds have less space to themselves than an A4 sized piece of paper. The birds' ability to move is also restricted by their unnatural growth rate — three times faster than natural — which makes their bodies so heavy as they get older that many struggle to move to reach for food and water. Others suffer heart failure as their hearts struggle to cope under the pressure of their overweight bodies.

Twenty million chickens die in these conditions each year.

Fast food giant KFC (which sources large numbers of chickens from Steggles) was quick to pull its "free to roam" claims from its website after the charges were laid. But the defendants continue to use their misleading claims, of which 'free to roam' is just one example. Modern chicken farms are like Club Med for chickens! Instead of slandering the Poultry Industry, how about you and your little "fluffy bunny brigade" try to come up with other solutions on how to fee the population! You are typical Chardonnay Socialists!!!!

One of the great achievements of modern technology is using hidden cameras to make the invisible, visible. Over the past 12 months I have been appalled and disgusted by the treatment of animals both in Australia and overseas. It seems that wherever there are animals being kept and used by humans there is cruelty. Chicken farmers, animal exporters and abattoirs offer very good reasons for being a vegetarian. I'm not one yet but to not support these barbarians makes perfect sense. Again the useless, inadequate politicians in this county have done nothing to right the wrongs. It staggers me beyond belief that I still see animals crammed into trucks being transported in stifling heat with legs sticking out the side of the truck in excruciating discomfort in 2012. In some of the most important areas of human evolution we have not moved forward at all.

The cruelty to animals in todays farming is horrific!!... anyone who supports this should be ashamed!!!.... I have given up all animal products!!.... and will never support these industries again!!!!.... they care nothing for the welfare of the animals.... they lie to the public about the health benifits of eating meat and drinking cows milk!!!.... and the western world has never had so many health problem as it has today!!!!...... we are sick fat and nearly dead!!!

i am SICK everyday i drive to work onnthe freeway to see smashed chickens on the side of the road that have FALLEN OFF the horrible litlle plastic yellow cages they pack them in! what is up with that? why are all the carrier trucks GENERIC with NO DETAILS on them except a number plate? who can we complain to about that? and who counts every 'delivery'time how many are LOST in transit every single trip? surely there is a record of this.... how appalling, they dont show u that in their commercials, how they pack them off to the slaughter houses!!! SHAME ON STEGGLES - they make me SICK!!!

Why do we criticize people who eat meat for religious reasons when every celebration we have in Australia leads to a meat fest i call it.I don't call anyone or myself anything.I just do not eat red or white meat anymore.I eat a bit of fish.I don't eat  prawns or hardly any fish now either.Beans,vegetables, and rice or pasta is great.My doctor said we don't need meat.we get protein in beans and other foods that have protein.I don't think about meat at all now.It makes me uncomfortable to think i ever ate it.there is heaps of yummy food.Rosemary Stanton has good recipes.Sausage sizzles are making people fatter.I need to lose a bit  and i eat only a bit of fish.Gee the feathers fly and their are too many cat fights on here.THINK OF THE ANIMALS.

I'm a vegetarian, and I love chickens. After seeing how broiler chickens are treated, I am appalled. I just want to let animal planet know I am supporting them fully in this.

We all want better living conditions for ALL animals, but, as much as I would love them to listen, they wont. We are dealing with a world wide addiction to chicken, no matter where it comes from. Too much money is being made in this horrible industry, and sadly greed is coming before sense.

WTF can't these lazy ass companies have paddoicks with sheds with straw for bedding and high chicken proof fencing so they can at least behave like chickens in their short lives, are they that hard up for cash that they can't even do this one humane thing for the birds.R they just too damn spoilt and lazy to do the right thing.

Ruth ...I buy my eggs from a local hobby farm. The chooks run around the paddock in the day.  At night they are in a chicken shed as foxes are around.  So long as you can see the chooks for yourself, & see their living conditions , it not necessary to have them in your own backyard! This is in outer suburbs Southern Adelaide., 20 kms from the city.

Many years ago I had a girlfriend with family in the STEGGLES chicken industry.  The sheds smelt absolutely disgusting.  Her father would say "it smells like money to me... hehe".  Anyway,  one new years eve after a long week of hot Melbourne weather, the sheds nor the chickens could take it any longer.  Disease quicyly set in and the poor birds died in their tens of thousands (on one farm) - maybe >100,000 died.  So I spent that night all night shovelling dead chickens into trucks whilst tractors came in and cleared out in bulk - running over many of course.  I threw up many times.  Many were still partially alive.  Happy new year!  Needless to say that was the end of that relationship.

We live opposite a chicken farm with 7 sheds each down dead chickens are brought down on the back of a trailer and thrown into bins that are collected by a truck. In summer it is far worse.

For everyone out there who has been busy writing and phoning politicians and protesting at rallies (as I have been), the content of the following recent (20th of September 2011) article (see link below) will be hearteningly good news. It indicates that all our campaigning efforts are bringing about a movement of change. Its very encouraging. So keep up the good work everybody as together we can make change happen and the world a better place for all animals.

We can re-label meat and dairy products all day long but the fact is eating them at all is what needs to stop.

Meat and dairy farming is all about supply and demand. Each person who goes vegan reduces that demand, and one by one we raise awareness that murdering animals is wrong and no one needs to eat them to survive. We can stop the killing by going vegan. Most people who are vegan are advocating for animals and many different levels and venues. When you change your lifestyle you are a walking billboard for it. We need to fight animal cruelty on ALL fronts and get everyone involved who is willing to fight.
